Tricare Help

To be covered, spouse needs 20 years with same service member

Q. My ex-wife has no insurance even though she was married to me for 20 years, 12 of which were on active duty. She was also previously married to another soldier on active duty for 10 years. You would think she had earned her right to remain on Tricare after being with active-duty service members 22 years collectively. We are split, but it bothers me that although she was a loyal military dependent she has no benefits whatsoever.  Is there anything I can do to appeal her coverage eligibility?

The federal law that governs Tricare eligibility requires marriage to the same military sponsor for at least 20 years during which time the sponsor accumulates enough points needed for retirement.  You stopped accumulating points when you retired.

According to your letter, it appears that your former wife put in her time, but not with the same sponsor as the law requires.

You should have an official talk with somebody about this so the facts are clearly resolved in your mind.  I suggest that you call the DEERS Support Office, toll-free, at 1-800-538-9552.
